Terms of Use
1surface is a desktop app for organising Ableton Live projects and creating and playing audio previews.
About these terms
These terms govern your use of the website and app. Earlier purchase agreements and refund commitments remain protected; our refund policy explains those commitments. Please read them before using 1surface. By installing or using the app, you agree to these terms.
1surface is provided by 1SURFACE LTD, registered in Scotland under company number SC898747. Our registered office is Unit 33, Morris Park, 37 Rosyth Road, Glasgow, United Kingdom, G5 0YD. You can contact us at contact@1surface.com.
Using 1surface
We give you a non-exclusive licence to install and use 1surface on devices you own or control, for personal or professional music work, while you comply with these terms. We retain ownership of the software and branding.
You must not resell or redistribute the software without our permission, interfere with its security, access accounts or systems without authorisation, or use it unlawfully or in a way that infringes another person’s rights.
These restrictions do not limit rights granted by applicable law or the licences of included open-source components, including permitted interoperability work.
Your account
You do not need an account to use the local Library, preview generation or playback.
When you create an account, provide accurate information, choose a handle you are entitled to use and keep your sign-in details secure. Tell us promptly if you believe someone has accessed your account without permission. If you use 1surface on behalf of an organisation, you must be authorised to do so.
Your music stays yours
You retain your rights in your music, projects and other content, including previews created from them using 1surface. Using the app does not give us ownership of your content or the right to publish it, sell it or license it to others for their own use.
You are responsible for having the rights needed to use your content, including any samples, recordings and other third-party material. If you send us files for support, we may use them only as needed to handle your request.
Working with Ableton Live
Some features require your own compatible, properly licensed copy of Ableton Live and any relevant plug-ins or content. 1surface is independent of Ableton and is not made, sponsored or endorsed by it. Ableton and Ableton Live are trademarks of their respective owner.
Preview generation operates Ableton Live on your computer. Automated operations may interrupt other work in Live or fail if software, permissions or project content are unavailable. Save your work, keep suitable backups and check the results before relying on them. Stopping an operation may not reverse actions already completed.
These precautions do not reduce our responsibility to provide the software with reasonable care and skill.
Privacy
Our Privacy Policy explains what personal information we process, why we use it and the choices available to you. Agreeing to these terms does not give consent to optional analytics or marketing.
Availability and changes to the service
Beta features may contain errors and may change as development continues. We do not guarantee uninterrupted availability or compatibility with every combination of hardware, software and plug-ins.
We may make reasonable changes for security, legal compliance, compatibility or improvements to the service. We will give reasonable notice before materially reducing the service or ending the beta, unless an urgent security or legal issue requires earlier action. Any rights you already have under these terms or applicable law remain protected.
Ending use
You can stop using 1surface at any time. You can request account deletion in the app or by contacting us. Uninstalling the app does not itself delete your account; the Privacy Policy explains how deletion works.
We may restrict or end access where reasonably necessary to address a serious or repeated breach of these terms, prevent harm or comply with the law. Unless immediate action is necessary, we will explain the reason and give you a reasonable opportunity to respond or put things right.
Our responsibility to you
We will provide 1surface with reasonable care and skill. We are responsible for loss or damage that is a foreseeable result of our breach of these terms or failure to use reasonable care and skill. We are not responsible for losses that were not reasonably foreseeable when the agreement was made.
For business use, we are not responsible for indirect or consequential business losses. This does not affect liability that cannot lawfully be excluded.
Nothing in these terms excludes liability for fraud, fraudulent misrepresentation, or death or personal injury caused by negligence. Nothing removes any consumer rights or other rights and remedies that the law does not allow us to exclude.
Changes to these terms and disputes
We may update these terms to reflect changes in the law, security requirements or the service. We will give advance notice of material changes and seek your agreement where required. Where an urgent legal or security change cannot wait, we will explain it as soon as reasonably possible. Changes will not remove rights you have already acquired.
These terms are governed by Scots law, and disputes may be brought in the Scottish courts. If you are a consumer, you also retain the mandatory protections and rights to use courts available under the law of the country where you live.
