Terms of Use

1surface is currently pre-release and is not yet publicly available. These terms cover use of this website now. The product terms for the desktop software and associated cloud features apply once you are granted access. Read them before using the product.

Who we are

1SURFACE LTD, registered in Scotland with company number SC898747, has its registered office at Unit 33, Morris Park, 37 Rosyth Road, Glasgow, United Kingdom, G5 0YD. Contact contact@1surface.com about these terms or the service.

Accounts and access

Provide accurate account information, keep your sign-in credentials secure and use only accounts you are authorised to use. Tell us promptly if you believe your account has been compromised. If you use 1surface for an organisation, you must have authority to act for it.

Access to account-based and cloud features depends on account approval and the permissions available to your account. Creating an account or requesting access does not guarantee approval. You can contact us to ask for an access decision to be reconsidered.

Software licence

While you comply with these terms, we grant you a limited, non-exclusive licence to install and use the 1surface software on devices you own or control for your personal or internal business music work. We retain rights in the software and branding. You may not resell, sublicense or redistribute the software without permission, except where applicable law or an included open-source licence permits it.

Open-source components remain subject to their own licences. These terms do not restrict rights those licences or applicable law give you, including any permitted interoperability work.

Acceptable use

Do not use 1surface unlawfully, infringe other people’s intellectual-property or privacy rights, upload malicious code, interfere with the service, access another person’s account without permission, or bypass access controls or usage limits. Only provide content and instructions you have the right to use and have processed by the service.

Your music and AI results

You retain your rights in the music, projects and other content you bring to 1surface. You permit us and the service providers involved to process that content as needed to provide the features you request, as explained in the Privacy Policy. These terms do not give us ownership of your music.

AI responses may be inaccurate, incomplete or similar to responses supplied to others. We do not promise that output is unique, eligible for copyright protection or free of third-party rights. Review results and obtain any permissions needed before publishing or otherwise relying on them.

Automation and Ableton Live

1surface can read information from and make changes in Ableton Live in response to your instructions. An instruction can lead to multiple actions without a separate confirmation for every action. Check the request, keep suitable backups and review the resulting project state.

An interrupted, cancelled or failed request may already have changed your project. Stopping a request does not necessarily undo completed actions, and some actions may not be reversible. We cannot promise that the app’s response always establishes the final state of Live.

You need your own compatible, properly licensed copy of Ableton Live and any relevant plug-ins or content. 1surface is an independent product and is not made, sponsored or endorsed by Ableton. Ableton and Ableton Live are trademarks of their respective owner. Integration behaviour can change with Live, operating-system or plug-in updates.

Plans, payment and subscriptions

The current app does not provide an in-app checkout. A plan label in your account is not, by itself, an agreement to pay. Any paid offer must state the price, taxes, billing period, renewal, cancellation and refund terms before you agree to it. We will not turn free access into a paid subscription without your agreement. These terms do not waive statutory cancellation or refund rights.

Third-party services

Cloud AI and account features depend on third-party hosting, authentication and model services. They may be unavailable or change independently of 1surface. Third-party software, sign-in services and content can have their own terms. Our use of service providers does not remove any responsibility we owe you under applicable law.

Availability, updates and ending use

1surface is developing and may contain errors. We do not promise uninterrupted availability, compatibility with every setup or that every request will succeed. We may make reasonable changes for security, legal compliance, compatibility or service improvements, and will give reasonable notice of changes that materially reduce a service you have agreed to receive, where practicable.

We may restrict or suspend access where reasonably necessary to investigate a serious breach, prevent harm, protect the service or comply with law. Where appropriate, we will explain the reason and allow you to respond or remedy the problem. We may end access for a serious or repeated breach, or if the service is discontinued, with reasonable notice where practicable. Any applicable rights relating to a paid service remain.

You may stop using the app at any time. Account deletion is available in the app or through contact@1surface.com and is subject to the recovery period explained in the Privacy Policy. Uninstalling the app or signing out does not itself delete your account or information held by service providers.

Care, warranties and liability

We will provide the service with reasonable care and skill. Nothing in these terms excludes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or removes rights or remedies that cannot lawfully be excluded. Consumers retain their statutory rights concerning digital content and services.

We are responsible for loss or damage that is a foreseeable result of our breach of these terms or failure to use reasonable care and skill. We are not responsible for losses that were not reasonably foreseeable when the contract was made. If you use 1surface for business purposes, we are not responsible for indirect or consequential business losses, subject to the protections above. The AI and automation limitations described here do not excuse a breach of our legal duties.

Governing law and disputes

These terms are governed by Scots law. You and we may bring proceedings in the Scottish courts. If you are a consumer, this does not remove mandatory protections under the law of the country where you live or your right to use courts available to you under that law. Contact contact@1surface.com first if you want to raise a concern; this does not prevent you from using other legal remedies.

Changes to these terms

The current version is published at 1surface.com/terms and linked from the app. We may revise it for legal, security or product changes. We will communicate material changes before they take effect where practicable, and seek agreement where required. If you do not wish to accept a change, you can stop using the service and contact us about any affected paid access. Changes do not remove rights already accrued.
